Trump DOJ Dismisses EMTALA Lawsuit, Leaves Pregnant Patients to Die (Chicago, IL) – (March 5, 2025) – The U.S. Department of Justice (DOJ) withdrew its challenge to Idaho’s ban on emergency abortion care, Idaho and Moyle, et al. v. United States. By ending this case, the Trump administration is signaling it will not uphold the Emergency Medical Treatment and Labor Act (EMTALA), a nearly 40-year-old law protecting pregnant patients’ rights to life-saving abortion care. In response to today’s court action, Personal PAC President and CEO Sarah Garza Resnick issued the following statement:
“The Trump administration is abandoning pregnant people and leaving them to die. In siding with anti-abortion extremists, the Trump Department of Justice is emboldening other anti-abortion politicians and operatives to ignore federal law and abandon pregnant patients. This action shows what the Trump administration thinks of women: they would rather their pregnant constituents suffer, or die, than have an abortion.
“Fortunately, responsible legislators in Illinois passed, and Governor JB Pritzker signed into law, the Hospital Emergency Service Act in 2024. The government should never prevent Americans from accessing health care.
