WILL COUNTY CLERK – IN REGARDS TO JOLIET TOWNSHP COURT ORDER (Joliet, IL) – The inability to accept the Resolution to nominate Mr. Guerrero to fill the vacancy in the Joliet Township race was not made unilaterally. This action was carried out after reviewing the election law and on the advice of my legal counsel, the Will County State’s Attorney’s Office.

I will continue to follow the law and will include on the April 1, 2025 ballot the name of Cesar Guerrero for the office of Township Supervisor of Joliet Township pursuant to the court Order entered today unless a higher court rules otherwise.

The law and the facts were clear to myself, the Illinois State Board of Elections and the office of James W. Glasgow Will County State’s Attorney. January 23, 2025 was the deadline for Cesar Guerrero to comply with state laws regarding ballot eligibility and he failed to do so.  Guerrero admitted on the witness stand that he received notices from the State Board of Elections stating that if he did not pay his fines by January 23, 2025 he would not be eligible to run for any elected office at any level of government anywhere in Illinois.

The Will County State’s Attorney’s office has indicated to me that they intend to appeal the decision.

Why she ruled the way she did remains to be seen. The written decision detailing her reasoning will be entered and sent to the parties within seven days. If Judge Breslan can hear arguments, review case law and statutes and render her verbal opinion in 24 hours she can certainly draft her detailed written opinion within 48 hours.

There will be an Appellate Court process and due to the ballots needing to be printed on an emergency basis following the February 25, 2025 primary election, I implore the Judge to issue her written opinion by this Monday, February 24, 2025.
