Chicago City Council Vote on Hemp Regulation Draws Criticism from Industry Advocates (Chicago, IL) – A Chicago City Council vote to regulate federally legal hemp products is drawing sharp criticism from hemp industry advocates, who argue the new rules favor large beverage and restaurant interests while limiting access to products used by seniors, veterans and medical patients.

The legislation approved this week allows liquor establishments and restaurants to sell intoxicating THC-infused beverages but bans the sale of hemp-derived gummies and other edible products. Supporters of the measure say it is intended to address public safety concerns, particularly involving children, while opponents contend it does little to achieve that goal.

Craig Katz, a representative of the Illinois Healthy Alternatives Association, said the ordinance was drafted without meaningful input from the hemp industry.

“The legislation passed today was written hastily and without any input from the hemp industry who is actually affected by the legislation,” Katz said. “It does little to protect children but does allow bigger profits for big beverages, big cannabis and the restaurant industry.”

Katz said his organization repeatedly sought discussions with Ald. Marty Quinn, who sponsored the legislation, to advocate for what he described as responsible regulation. Those proposals included prohibiting sales to anyone under 21, standardizing product labeling to avoid child-friendly “look-alike” packaging, and requiring consistent testing of hemp products.

“He would not talk to representatives from the industry he is destroying, but he has met again and again with the industries that he is enriching,” Katz said, adding that campaign contributions tied to the issue should be closely examined.

Critics also argue that shifting THC beverage sales to establishments that already sell alcohol could increase risks rather than reduce them. According to state data, Illinois recorded 399 alcohol-involved fatal crashes in 2023, accounting for 32% of all traffic fatalities and placing the state among the top 10 nationwide for such crashes. In Chicago, traffic crashes and injuries reached record levels in 2024, with impaired driving cited as a significant factor.

An Illinois Department of Public Health report released in December found that about 23% of Illinois high school students reported drinking alcohol. By comparison, industry advocates point to federal data indicating that since 2009, only four child deaths nationwide have listed cannabis as a possible contributing factor, according to the Centers for Disease Control and Prevention and the National Institutes of Health.

Opponents of the ordinance say the ban on edible hemp products will have unintended consequences for people who rely on them for health and wellness purposes. Katz said seniors, cancer patients, veterans and individuals managing chronic pain, stress or sleep disorders often use CBD and hemp-derived gummies as alternatives to prescription medications.

Families of children with epilepsy and other seizure disorders could also be affected, advocates said, as those products will no longer be legally sold in the city. While similar items may be available through licensed cannabis dispensaries, critics argue they are often more expensive and less accessible.

City officials have said the ordinance is a step toward regulating a rapidly evolving market, but industry representatives maintain that the approach prioritizes profits over public health and limits consumer choice.
